The recently published issue 1 of 2025 of L’Ircocervo (vol. 24) features a new contribution by Silvia Bagni, coordinator of the LUMEN project, entitled From Environmental Law to the Law of Ecosystem Relations (pp. 41-61).
In her article, Bagni addresses the climate crisis and the broader ecological crisis of the planet, highlighting the inability of current environmental law to provide effective tools to tackle it. The author proposes a new branch of law dedicated to ecosystem relations, considering the interactions between human, non-human, and environmental entities, advocates for the recognition of legal subjectivity not limited to non-human beings, and emphasizes the intergenerational dimension of law, extending a form of legal subjectivity to past and future generations.
This approach aims to overcome the traditional categories of so-called “fossil law,” offering a more inclusive, ecocentric, and relational legal framework capable of responding to the challenges of the climate and ecological crisis.
