"The Universal Judgment (or Silence?): A Ruling That Will Not Make History" is a new LUMEN article by Rachele Cecchi, a member of the UNIFI research unit, published in Diritti comparati on May 15, 2024.
The article explores the inadmissibility ruling issued on February 26, 2024, by the Rome court in the case A SUD and others against Italy, the first Italian climate lawsuit. It analyzes the claim made by the petitioners, who denounced the inadequacy of the State's climate change policies. The court argued that decisions regarding climate change fall within the purview of political bodies. Furthermore, the ruling is compared to the recent decision by the European Court of Human Rights against Switzerland, highlighting the argumentative shortcomings of the Italian ruling and the importance of the right to live in a healthy environment, which has been recently recognized by the Italian Constitution.
