The research project aims to verify whether the most recent revision of articles 9 and 41 of the Constitution of the Italian Republic can be framed in such a way as to establish a new legal approach to the environmental issue. The working hypothesis is that the formalization of the protection of the environment, ecosystems and animals as a fundamental principle of the Italian legal system has brought a substantial modification to the constitutional pact which will entail a significant transformation of the powers of the State as well as the methods of their exercise. The research question is focused from three different points of view: the political-legislative one, the territorial-administrative one and, finally, the judicial one.
The project is led by the University of Bologna (P.I. Prof. Andrea Morrone) together with the University of Naples Parthenope (Sub. P.I. Prof. Anna Papa) and the University of Bari Aldo Moro (Ass. P.I. Prof. Antonio Gusmai ). The complete composition of the 3 Units respects the balance between genders, being made up of 9 females and 6 males overall. Furthermore, the composition reflects all the research areas that will be the subject of the investigation. In accordance with the “open science” approach pursued by EU research and innovation policies, the results will be disseminated through open access publications.
The head of the project is Prof. Andrea Morrone, full professor of constitutional law at the Department of Legal Sciences of the University of Bologna. The Bologna Unit also includes Prof. Tommaso Francesco Giupponi, Full Professor of Constitutional Law, Prof. Diletta Tega, Full Professor of Constitutional Law, Prof. Corrado Caruso, associate professor of Constitutional Law, professor Chiara Bologna, associate professor of constitutional law, Dr. Caterina Domenicali, researcher in constitutional law and Dr. Alberto Arcuri, research fellow in constitutional law at the University of Bologna.
The Unit of the Parthenope University of Naples is chaired by Prof. Anna Papa, full professor of public law institutions at the Parthenope University of Naples. The unit is then made up of Prof. Paola Mazzina, full professor of constitutional law, Prof. Valeria De Santis, associate professor in public law institutions, and Dr. Andrea Napolitano, researcher in public law institutions.
The Unit of the University of Bari is chaired by prof. Antonio Gusmai, associate professor in public law institutions at the University of Bari, and is composed of prof. Anna Maria Nico, full professor of public law institutions, prof. Giovanni Luchena, full professor of economic law, by Prof. Maria Grazia Nacci, associate professor in public law institutions and by Dr. Stefania Cavaliere, researcher in economic law.
